GreenSense Terms of Service

1. Acceptance of Terms

By accessing or using GreenSense ("Service"), operated by APTEC Solutions PTY LTD (ABN: 17 645 912 947) ("Company", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Service Description

GreenSense is an AI-powered lawn care scheduling platform that provides:

  • Personalized lawn care recommendations based on AI analysis

  • Weather-integrated scheduling suggestions

  • Lawn management tools and calendar features

  • Educational content about lawn care practices

    • IMPORTANT DISCLAIMER: GreenSense provides general informational guidance only. Our AI recommendations are not professional lawn care advice and should not replace consultation with qualified lawn care professionals.

    3. AI Recommendations Disclaimer

    3.1 Nature of AI Recommendations


  • All lawn care recommendations are generated by artificial intelligence

  • AI recommendations are based on general patterns and may not be suitable for your specific lawn conditions

  • Weather forecasts are provided by third-party services and may not be accurate

  • You are solely responsible for evaluating the suitability of any recommendations

    • 3.2 Limitation of Liability for AI Recommendations


    TO THE MAXIMUM EXTENT PERMITTED BY LAW:
  • We disclaim all liability for any damage to your lawn, property, or health resulting from following our AI recommendations

  • We are not responsible for the accuracy of weather forecasts or their impact on lawn care timing

  • We do not guarantee the effectiveness or safety of any recommended treatments

  • You assume all risks associated with implementing our recommendations

    • 3.3 Professional Advice Recommendation


  • Always consult with qualified lawn care professionals for specific lawn issues

  • Seek professional advice before using any chemical treatments

  • Consider local regulations and restrictions on lawn care products

  • Verify product safety and application instructions independently

    • 4. User Responsibilities

    4.1 Accurate Information


  • You must provide accurate information about your lawn and property

  • You are responsible for updating your lawn information as conditions change

  • False or misleading information may result in inappropriate recommendations

    • 4.2 Safe Implementation


  • You must follow all product safety instructions and warnings

  • You are responsible for ensuring safe application of any recommended treatments

  • You must comply with all local laws and regulations regarding lawn care

  • You must consider environmental factors and neighbor considerations

    • 4.3 Account Security


  • You are responsible for maintaining the security of your account

  • You must not share your account credentials with others

  • You must notify us immediately of any unauthorised account access

    • 5. Beta Testing Terms

    5.1 Beta Service Nature


  • GreenSense is currently in beta testing phase

  • The Service may contain bugs, errors, or incomplete features

  • We reserve the right to modify or discontinue features without notice

  • Service availability is not guaranteed

    • 5.2 Beta User Expectations


  • Beta users should expect occasional service interruptions

  • Features may change or be removed during the beta period

  • We appreciate feedback but cannot guarantee implementation of suggestions

  • Beta users help improve the Service but should not rely on it for critical lawn care decisions

    • 6. Credit System and Payments

    6.1 Credit System


  • Credits are consumed for AI schedule generation, weather forecasts, and other AI features

  • Credits are non-refundable

  • We reserve the right to modify credit costs and system rules

  • Credit Expiration Policy:

    • - Signup Credits: 1000 credits on signup, expire in 90 days
    - Monthly Free Credits: 100 free credits topped up monthly (on your registration anniversary), do not expire
    - Purchased Credits: Expire 12 months after purchase
    - Expired credits cannot be used
  • Credits may be forfeited if account is terminated

    • 6.2 Monthly Free Credits


  • GreenSense provides 100 free credits every month to all registered users

  • Monthly credits are topped up on your registration anniversary date each month

  • Credits are only topped up if your balance is below 100 credits

  • If your balance is 100 or more credits, no top-up occurs (your balance remains unchanged)

  • Monthly free credits do not expire

  • We reserve the right to modify or discontinue the free credit program with reasonable notice

    • 6.3 Payment Terms


  • All prices are in Australian Dollars (AUD) and include GST where applicable

  • Payment processing is handled by third-party providers

  • Credits are non-refundable

  • Purchased credits stack on top of your existing balance

    • 7. Data Collection and Privacy

    7.1 Data Collection


    We collect the following information:
  • Personal information (name, email, address)

  • Lawn information (size, grass type, care preferences)

  • Usage data (AI interactions, scheduling patterns)

  • Location data (for weather and lawn care recommendations)

    • 7.2 Data Use


  • Data is used to provide personalized lawn care recommendations

  • We may use anonymized data for service improvement and research

  • We do not sell personal information to third parties

  • See our Privacy Policy for detailed information about data handling

    • 7.3 Data Security


  • We implement reasonable security measures to protect your data

  • However, no system is 100% secure

  • You acknowledge that data transmission over the internet carries inherent risks

    • 8. Intellectual Property

    8.1 Our Content


  • All content, including AI recommendations, is owned by APTEC Solutions PTY LTD

  • You may not copy, modify, or distribute our content without permission

  • Our trademarks and logos are protected intellectual property

    • 8.2 Your Content and Licence Grant

    8.2.1 Content Ownership


  • You retain ownership of all content you upload, including photos, lawn information, and other data

    • 8.2.2 Licence Grant


    By uploading content to the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to:
  • Store, process, and display your content for service functionality

  • Create derivative works (thumbnails, optimised versions, etc.)

  • Use anonymised and aggregated content for AI training and service improvement

  • Retain content in backups for up to 90 days after deletion

  • Use content as required for legal compliance

    • 8.2.3 Marketing Use (Optional)


    With your explicit opt-in consent, we may use your photos for marketing and promotional purposes. You can revoke this consent at any time in your account settings.

    8.2.4 Content Responsibility


    You represent and warrant that:
  • You own or have the right to upload all content

  • Content does not violate any third-party rights

  • Content complies with these Terms and applicable laws

  • You will indemnify us against any claims related to your content

    • 8.3 Image Uploads and User-Generated Content

    8.3.1 Permitted Content Only


    You may only upload images of product labels, lawn care products, lawn photos, or other content directly related to lawn care management.

    8.3.2 Prohibited Content


    You must not upload any content that:
  • Contains illegal, harmful, or inappropriate material

  • Contains pornography, explicit sexual content, or nudity

  • Contains violence, hate speech, or discriminatory content

  • Infringes on intellectual property rights of others

  • Violates any applicable laws or regulations

    • 8.3.3 Photo Processing Consent


    By uploading photos, you consent to:
  • AI processing of photos for grass type identification and product recognition

  • Automated content moderation using third-party content moderation services

  • Storage of photos on third-party cloud storage services (may be located outside Australia)

  • Processing of photos by third-party AI and OCR services

    • 8.3.4 Photo Storage and Security


  • Photos are stored on third-party cloud storage services

  • Photo URLs may be publicly accessible if the URL is known

  • We implement API-level access controls to prevent unauthorised access

  • However, you acknowledge that no system is 100% secure

  • You acknowledge that photo URLs may be accessible if known, and we are not liable for unauthorised access to photos through URL leakage, security breaches, or other means

  • You use photo storage services at your own risk

  • We are not responsible for any consequences of unauthorised access to your photos

    • 8.3.5 Photo Deletion


  • You may delete photos at any time through the Service

  • Deleted photos are removed from storage services within 30 days

  • We are not responsible for photos that have been deleted, lost, corrupted, or damaged

  • Once deleted, photos cannot be recovered

  • We are not liable for any loss of photos due to deletion, corruption, technical failures, or storage provider issues

  • Photos may be retained in backups for up to 90 days

  • We are not responsible for backup failures or inability to recover photos from backups

    • 8.3.6 AI Processing Limitations and Waiver


    You acknowledge and agree that:
  • AI processing of photos may not be 100% accurate

  • Grass type identification is an estimate, not a guarantee

  • OCR product recognition may contain errors

  • You are solely responsible for verifying all AI-identified information

  • We are not liable for any consequences of relying on AI identification

  • You waive any claims related to AI processing accuracy

  • You understand that AI technology has inherent limitations

  • You will not hold us responsible for incorrect AI identifications

    • 8.3.7 Content Moderation


  • We use automated content moderation systems to detect inappropriate content

  • Images are automatically scanned for prohibited content

  • Uploads containing inappropriate content will be automatically rejected and deleted

  • We reserve the right to review, remove, or reject any uploaded content at our sole discretion

  • Moderation decisions are final and not subject to appeal

  • We are not required to explain moderation decisions

  • False positives may occur (legitimate photos may be rejected)

  • You waive any claims related to content moderation decisions

  • We are not liable for photos that are incorrectly flagged or rejected

    • 8.3.8 Account Consequences


  • Uploading prohibited content may result in immediate account suspension or termination

  • Repeated violations may result in permanent ban from the Service

  • We reserve the right to report illegal content to appropriate authorities

    • 8.3.9 Your Responsibility


  • You are solely responsible for all content you upload

  • You represent and warrant that all uploaded content complies with these Terms

  • You agree to indemnify us against any claims arising from your uploaded content

    • 8.3.10 Photo Data Breach and Security Liability Waiver


    You acknowledge and agree that:
  • We are not liable for any damages, losses, or consequences resulting from unauthorised access to, or breach of, photo data stored on third-party services

  • We are not liable for any damages resulting from security breaches, data breaches, or unauthorised access to photo storage systems

  • We are not responsible for any consequences of photo data being accessed, disclosed, or compromised due to third-party service failures, security vulnerabilities, or other causes beyond our control

  • You waive any claims against us related to photo data breaches, security incidents, or unauthorised access to your photos

  • We are not liable for any loss, damage, or disclosure of photos due to storage provider bankruptcy, closure, or business discontinuation

  • You understand that storing photos on third-party services carries inherent risks, and you assume all such risks

    • 9. Third-Party Services

    9.1 External APIs


    Our Service integrates with third-party services including:
  • AI services (AI processing)

  • Google Places API (address validation)

  • Weather services (forecast data)

  • Payment processors

    • 9.2 Third-Party Liability and Waiver


    You acknowledge that:
  • We use third-party services for photo storage, AI processing, and content moderation

  • Third-party services may experience outages, errors, or failures

  • We are not responsible for third-party service availability or accuracy

  • You waive any claims against us related to third-party service failures

  • We are not liable for data loss, corruption, or unavailability due to third-party services

  • Third-party service changes may affect Service functionality

  • You use third-party services at your own risk

  • Third-party services have their own terms and privacy policies

    • 10. Service Availability

    10.1 Uptime


  • We strive to maintain high service availability but do not guarantee 100% uptime

  • Scheduled maintenance may cause temporary service interruptions

  • We will provide reasonable notice of planned maintenance when possible

    • 10.2 Service Modifications


    We reserve the right to:
  • Modify, suspend, or discontinue the Service at any time

  • Add, remove, or modify features without notice

  • Change pricing, credit costs, or service terms with 30 days' notice

  • Discontinue features or functionality without liability

  • Change third-party service providers (photo storage, AI services, etc.)

  • Modify or remove user content if it violates Terms or for operational reasons

  • Limit or restrict access to the Service for any reason

    • You acknowledge that:

  • The Service may change significantly over time

  • Features you rely on may be removed or modified

  • We are not liable for service modifications or discontinuations

  • Changes will be communicated through the Service or via email when possible

    • 11. Termination

    11.1 Termination by You


  • You may terminate your account at any time

  • Account termination will result in loss of access to your data

  • We will retain your data for the period specified in our Privacy Policy

    • 11.2 Termination by Us


  • We may terminate your account for violation of these Terms

  • We may suspend or terminate accounts for abuse or misuse

  • We will provide reasonable notice before termination when possible

    • 12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW:

    12.1 General Limitations


  • Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim

  • We are not liable for indirect, incidental, special, or consequential damages

  • We are not liable for loss of profits, data, or business opportunities

    • 12.2 Specific Exclusions


  • We are not liable for lawn damage resulting from following our recommendations

  • We are not liable for inaccurate weather forecasts or their consequences

  • We are not liable for third-party service failures or data breaches

  • We are not liable for any damage caused by misuse of the Service

    • 13. Indemnification

    13.1 Your Indemnification Obligations


    You agree to indemnify, defend, and hold harmless APTEC Solutions PTY LTD, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable solicitor fees) arising from:
  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)

  • Any damage caused by following our AI recommendations

  • Your uploaded content (photos, data, information)

  • Any misuse or abuse of the Service

  • Any claims by third parties related to your use of the Service

  • Your failure to comply with applicable laws or regulations

    • 13.2 Our Rights


    We reserve the right to:
  • Assume exclusive defence and control of any matter subject to indemnification

  • Require your cooperation in defending such claims

  • Recover our legal costs and expenses from you

    • 14. Dispute Resolution

    14.1 Governing Law


    These Terms are governed by the laws of New South Wales, Australia.

    14.2 Dispute Process


  • We encourage resolution of disputes through direct communication

  • If direct resolution fails, disputes will be resolved through binding arbitration

  • Arbitration will be conducted in Sydney, Australia

  • You waive any right to participate in class action lawsuits

  • You waive any right to a jury trial

  • All disputes must be resolved individually, not as part of a class action

  • You agree not to bring or participate in any class action against us

    • 15. General Provisions

    15.1 Entire Agreement


    These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

    15.2 Severability


    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

    15.3 Amendments


    We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use constitutes acceptance of modified Terms.

    15.4 Force Majeure


    We are not liable for any failure to perform due to circumstances beyond our reasonable control.
